Gauhati High Court Quashes NSA Detention of Victor Das

The Gauhati High Court on Friday set aside the detention of Victor Das under the National Security Act, citing violation of constitutional safeguards. The court said the state failed to inform Das of his right to make a representation before the detaining authority and delayed disposal of his representations.

The bench held that the unexplained delay of 17 days by the state government was fatal to the detention order and directed Das’s immediate release, if not required in any other case.
