Assam Govt Challenges Gauhati HC Stay on APSC Cash-for-Job Scam Proceedings
The Assam government on Wednesday challenged the Gauhati High Court’s stay on departmental proceedings against 17 officers accused in the APSC cash-for-job scam. A petition was filed before a division bench of Justices Kalyan Rai Surana and Malasri Nandi to overturn the single bench order.
Additional Advocate General Nalin Kohli argued that the inquiry commission adhered to Section 8 (B) and (c) of the Commission of Inquiry Act, which ensures the accused’s right to be heard and present evidence.
The High Court had stayed the proceedings on February 7, citing that the inquiry report was not shared with the accused or tabled in the Assembly, a legal requirement. The Justice BK Sharma committee report was finally tabled on February 17.
